Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Control ("Control," "we," "us," or "our"). They govern your access to and use of the Control website, desktop application, mobile and remote features, community, software, and related services (collectively, the "Service"). By creating an account, downloading the application, purchasing access, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Control provides desktop-native tools for interviews, assessments, meetings, and related workflows. Depending on your device and plan, features may include microphone or system-audio capture, transcription, screenshot capture, uploaded reference materials, AI-generated responses, a private overlay, remote controls, and collaboration with an invited helper. Certain processing occurs on your device, while other processing occurs through our systems and third-party service providers.
Features, supported platforms, usage limits, and availability may change. We may add, modify, suspend, or discontinue any part of the Service, including beta or free features. We do not promise that a particular feature, model, provider, operating system, or integration will remain available.
2. Eligibility and authority
- You must be at least 13 years old to use the Service.
- If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
- If you use the Service for an organization, you represent that you have authority to bind that organization, and "you" includes the organization.
- You may not use the Service if applicable law prohibits you from receiving it or if we have previously terminated your account for a serious violation of these Terms.
3. Accounts and security
You must provide accurate, current information and keep it up to date. You are responsible for safeguarding your credentials, devices, access links, and account, and for activity conducted through your account. You may not share, sell, rent, or transfer account access except through a feature expressly provided by Control. Notify us promptly at [email protected] if you suspect unauthorized access. We may require identity or account verification before restoring access or acting on a sensitive request.
4. Your responsibilities
You are responsible for deciding whether and how to use Control. Before capturing or sending audio, screenshots, documents, messages, or other material, you must obtain all permissions and consents required by law, contract, workplace policy, interview rules, assessment rules, and the rules of any third-party platform. Recording and interception laws vary by location and may require the consent of every participant.
Control does not authorize you to misrepresent your work, identity, qualifications, or use of assistance. Employers, schools, assessment providers, meeting hosts, and other third parties may prohibit AI assistance, recording, overlays, remote collaboration, or similar tools. You assume the risk of consequences resulting from a violation of those rules.
5. Acceptable use
You may not use the Service to:
- violate any law, regulation, court order, contract, or legally binding third-party right;
- deceive, defraud, impersonate, harass, threaten, exploit, or cause harm to another person;
- obtain unauthorized assistance, evade proctoring or security controls, or defeat access, monitoring, or integrity safeguards where doing so is prohibited;
- upload or process content that you do not have the right to use, including confidential, proprietary, copyrighted, or personal information;
- distribute malware, probe or disrupt our systems, bypass usage limits, abuse promotions, automate account creation, or interfere with another user;
- scrape, crawl, copy, frame, resell, sublicense, or commercially exploit the Service except as we expressly permit in writing;
- reverse engineer, decompile, or attempt to discover source code or underlying components, except to the limited extent applicable law prohibits this restriction; or
- use output or access to develop, train, benchmark for publication, or improve a competing product without our written permission.
We may investigate suspected misuse and may preserve or disclose information when reasonably necessary to protect users, enforce these Terms, or comply with law.
6. Software license
Subject to these Terms and any applicable plan limits, Control grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the application on devices you own or control. The Service is licensed, not sold. Control and its licensors retain all rights not expressly granted to you. Open-source components are governed by their applicable licenses.
The application may download and install updates automatically. Updates may be required for security, compatibility, or continued access to the Service.
7. Your content
"User Content" means prompts, messages, audio, transcripts, screenshots, files, profile information, helper notes, feedback, and other material you submit to or process through the Service. As between you and Control, you retain ownership of your User Content.
You grant Control a worldwide, non-exclusive, royalty-free license to host, copy, transmit, reproduce, format, modify, and otherwise process User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, and improve the Service; comply with law; and enforce these Terms. This license lasts for as long as the content is stored by or for Control, subject to reasonable backup, legal, and security retention. You represent that you have all rights and permissions needed to provide User Content and grant this license.
8. AI-generated output
The Service may generate text, code, transcripts, summaries, or other output using artificial intelligence. Output may be inaccurate, incomplete, offensive, outdated, insecure, or similar to content generated for others. You must independently review and verify output before using or relying on it. You are responsible for your decisions, submissions, communications, and other uses of output.
The Service and its output are not professional legal, medical, financial, employment, or other expert advice and do not guarantee any interview, assessment, hiring, academic, or business outcome.
9. Collaboration and shared access
If you invite another person to a helper room or other collaborative feature, you authorize us to share the information shown by that feature with the invitee. You are responsible for whom you invite, the permissions you grant, and revoking access when it is no longer appropriate. Invitees must use shared information only with authorization and in accordance with these Terms. Access links and invitations may be account-bound, time-limited, or revoked for security reasons.
10. Purchases, subscriptions, and taxes
- Prices, plan duration, included usage, renewal terms, and other material purchase terms are presented at checkout. Prices may change for future purchases or renewal periods after any notice required by law.
- Fixed-duration passes are one-time purchases and expire at the end of the stated access window. Unused time or usage does not roll over unless the offer expressly says otherwise.
- Recurring plans renew automatically at the disclosed interval until cancelled. You authorize Control and its payment processor to charge the payment method on file for fees and applicable taxes at each renewal.
- You may cancel a recurring plan through the billing portal or by contacting support. Unless stated otherwise, cancellation takes effect at the end of the current paid period and you retain access until then.
- You are responsible for applicable taxes, duties, and similar governmental charges, except taxes based on our net income.
- Refunds and credits are governed by our Refund Policy and any non-waivable rights under applicable law.
11. Third-party services
The Service relies on and may link to third-party platforms, models, payment services, authentication services, operating-system features, and other products. Their terms and privacy practices govern your direct relationship with them. Control does not control and is not responsible for third-party services, content, availability, or acts. A failure or change in a third-party service may affect Control features.
12. Feedback
If you voluntarily provide ideas, suggestions, or other feedback about Control, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use and commercialize it without restriction or compensation. This does not transfer ownership of your User Content.
13. Suspension and termination
You may stop using the Service at any time. You may request account deletion by contacting us. Cancellation of a subscription does not by itself delete your account or User Content.
We may limit, suspend, or terminate access if you breach these Terms, create risk or possible legal exposure, fail to pay amounts due, use the Service fraudulently or abusively, or if needed to protect the Service or others. Where reasonable, we will provide notice and an opportunity to cure, but we may act immediately for urgent security, legal, or abuse concerns. Upon termination, your license ends. Provisions that by their nature should survive will survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions.
14. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." CONTROL AND ITS LICENSORS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, UNDETECTABLE, OR COMPATIBLE WITH EVERY DEVICE OR THIRD-PARTY PLATFORM, OR THAT CONTENT OR DATA WILL NOT BE LOST. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTROL AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OPPORTUNITIES, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CONTROL FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY. THEY DO NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
16. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Control and its affiliates, licensors, service providers, officers, employees, and agents from claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable legal fees arising from your User Content, your use or misuse of the Service, your breach of these Terms, or your violation of law or another person's rights. Control may assume control of the defense of a matter subject to indemnification, and you agree to cooperate.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules. Subject to any rights that cannot be waived under applicable consumer law, the state and federal courts located in Delaware will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and you and Control consent to personal jurisdiction there. Before filing a claim, each party agrees to try in good faith for 30 days to resolve the dispute informally after receiving written notice describing the dispute and requested resolution.
18. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, or our practices. We will post the revised Terms and update the date above. If a change materially affects your rights, we will provide additional notice when required by law. Changes apply prospectively from their effective date. If you do not agree to revised Terms, you must stop using the Service and cancel any recurring plan. Your continued use after the effective date constitutes acceptance where permitted by law.
19. General terms
- Entire agreement. These Terms, the Privacy Policy, Refund Policy, checkout terms, and any other terms expressly incorporated by reference form the entire agreement about the Service.
- Order of precedence. If checkout terms conflict with these Terms, the checkout terms control only for that purchase and only to the extent of the conflict.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets, or by operation of law.
- Severability. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.
- No waiver. A failure to enforce a provision is not a waiver. Headings are for convenience only.
- Export and sanctions. You must comply with applicable export-control and sanctions laws and may not use the Service where such use is prohibited.
